The law enforcing agency under various labour laws is the Department of Labour of the appropriate government. In spite of generating adequate revenue for government through various means such as licensing fee, penalty for late submission of fee, inlposition of fine through court on employer for default on their part in implementation of the provisions of the various acts etc., the conditions under which it has to work are pathetic. Shortage of staff, wide coverage under different labour laws, vast geographical spread of the area under their administrative control, inefficiency of the staff are iome of the common malice from which the law enforcing agency suffers. Ranlpant corruption. lack of opportunity for periodic upgradation of knowledge & skills are also eclually responsible for the inefficiency of the system.
No doubt, judiciary through its various judgements have been giving liberal interpretation to various provisions\of the Acts to extend maximum possible benefit to the workers but in absence of an effective law enforcing agency, most of tlie employers do not extend the benefit to the workers. Most often the benefits of such liberal judgement renlain on paper.Moreover, judicial activism cannot do much without the support and co-operation of an effective and efficient law enforcing machinery.
